These Terms of Usage (“Terms”) govern your access to and use of www.monkonthego.com, its sub-sites, content, communication channels and the healthcare facilitation and related services offered by Monk On The Go (collectively, the “Site” and “Services”).

By accessing or using the Site, submitting an enquiry, requesting our Services, communicating with us, or otherwise engaging with Monk On The Go, you acknowledge that you have read, understood and agreed to these Terms, together with our Privacy Policy.

If you do not agree with these Terms, please do not use the Site or engage our Services.

ABOUT MONK ON THE GO

Monk On The Go is a healthcare facilitation and patient-support service that assists Patients and their Attendants in coordinating healthcare journeys, including medical evaluation, hospital and doctor coordination, second opinions, treatment planning, travel support and related concierge services.

Our Services may include:

  • Review and coordination of medical reports;
  • Coordination of second medical opinions;
  • Hospital and doctor matching;
  • Coordination of treatment estimates and admission processes;
  • Visa and travel documentation support;
  • Airport pickup and ground transportation;
  • Accommodation arrangements;
  • Interpretation and translation support;
  • In-hospital coordination and patient support;
  • Billing and administrative coordination;
  • Post-discharge coordination and follow-up;
  • Other healthcare facilitation and patient-support services communicated to you by Monk On The Go.

The scope of Services available to a particular Patient may vary depending on the Patient's requirements, medical condition, destination, Hospital Partner, availability and other circumstances.

IMPORTANT MEDICAL DISCLAIMER

Monk On The Go is a healthcare facilitator and coordinator. We are not a hospital, clinic, doctor or medical treatment provider unless expressly stated otherwise.

Medical diagnosis, treatment decisions, surgical procedures, prescriptions, clinical opinions and medical outcomes are determined exclusively by appropriately qualified healthcare professionals and Hospital Partners.

Any information provided by Monk On The Go regarding a doctor, hospital, procedure, treatment, estimated cost, expected duration, recovery period or medical pathway is provided for coordination and informational purposes and should not be treated as an independent medical opinion.

Monk On The Go does not:

  • Diagnose medical conditions;
  • Prescribe medicines;
  • Perform medical procedures;
  • Determine whether a Patient is medically fit for a particular treatment;
  • Guarantee that a particular treatment will be successful;
  • Guarantee any particular medical outcome;
  • Replace the professional advice of a qualified doctor.

Patients should obtain appropriate medical advice from their treating doctor and/or the relevant Hospital Partner before making medical decisions.

In an emergency, Patients should immediately contact the appropriate emergency medical service or healthcare provider and should not rely upon Monk On The Go's website, email, telephone or other communication channels as an emergency medical service.

HOSPITALS, DOCTORS AND OTHER SERVICE PROVIDERS

Monk On The Go may coordinate Services with hospitals, clinics, doctors, diagnostic centres, airlines, hotels, transportation providers, interpreters, visa facilitation agencies and other third-party service providers (“Service Providers”).

A Hospital Partner or other Service Provider remains independently responsible for the services it provides.

Monk On The Go does not control the independent professional judgment, medical decisions, treatment methods, availability, pricing, policies or performance of such Service Providers.

Where applicable, the contractual relationship for medical treatment may be directly between the Patient and the relevant Hospital Partner or healthcare professional.

Hospital charges, doctor fees, diagnostic charges, medicines, procedures and other healthcare expenses may be payable directly to the relevant Hospital Partner or Service Provider.

MEDICAL REPORTS AND INFORMATION PROVIDED BY YOU

Patients and their Attendants are responsible for ensuring that information and documents supplied to Monk On The Go are accurate, complete and authentic to the best of their knowledge.

This may include:

  • Medical reports;
  • Diagnostic reports;
  • Prescriptions;
  • Previous treatment records;
  • Passport information;
  • Visa information;
  • Contact details;
  • Travel information; and
  • Other documents required to coordinate the Services.

Any medical assessment, treatment recommendation, eligibility assessment or cost estimate based on information supplied by you may change if additional or updated information becomes available.

Monk On The Go shall not be responsible for consequences arising from inaccurate, incomplete, outdated, misleading or fraudulent information supplied by a Patient or Attendant.

MEDICAL OPINIONS, TREATMENT PLANS AND ESTIMATES

Where Monk On The Go facilitates a second opinion, treatment recommendation, treatment plan or hospital assessment, such opinion or recommendation is provided by the relevant doctor or Hospital Partner.

Treatment costs, package prices and estimates provided before admission or treatment are estimates unless expressly identified as a confirmed contractual package.

Actual costs may vary because of:

  • Additional investigations;
  • Changes in diagnosis;
  • Additional procedures;
  • Complications;
  • Extended hospitalisation;
  • Medicines and consumables;
  • Intensive care requirements;
  • Changes in treatment plans;
  • Additional services requested by the Patient; or
  • Other circumstances determined by the treating healthcare provider.

Monk On The Go does not guarantee that the final medical or hospital bill will correspond to an initial estimate unless expressly confirmed in writing as a fixed package by the relevant Hospital Partner.

PATIENT ELIGIBILITY AND ACCEPTANCE

Submission of an enquiry, medical report or registration form does not automatically constitute acceptance of a Patient for treatment.

The final decision regarding medical suitability, treatment eligibility, admission, procedure and timing rests with the relevant doctor and/or Hospital Partner.

Monk On The Go may also decline, suspend or discontinue facilitation where:

  • Required information or documentation is unavailable;
  • A Patient is medically unsuitable for the proposed arrangement;
  • Required payments are not made;
  • Visa or travel requirements cannot be fulfilled;
  • The requested Service is unavailable;
  • The Patient provides inaccurate or misleading information; or
  • Continuing the engagement would create legal, operational, safety or other material concerns.

VISA AND IMMIGRATION SUPPORT

Where offered, Monk On The Go may assist Patients and Attendants with documentation and coordination relating to medical visas, immigration or travel.

Such assistance does not constitute a guarantee that a visa or immigration permission will be granted.

Visa and immigration decisions are made exclusively by the relevant government authorities.

Monk On The Go shall not be responsible for delays, refusals, cancellations or other decisions made by immigration authorities, embassies, consulates or other government agencies.

Patients remain responsible for ensuring that their travel documents, passports, visas and other required documentation are valid and accurate.

TRAVEL, AIRLINE, ACCOMMODATION AND GROUND SERVICES

Where Monk On The Go arranges or coordinates travel, accommodation, airport transfers, transportation or related services, such services may be supplied by independent thirdparty providers.

Their respective terms, conditions, cancellation policies and restrictions may apply.

Monk On The Go shall not be responsible for delays, cancellations, loss of baggage, airline decisions, hotel policies, transportation incidents or other events arising from the independent acts or omissions of third-party providers, except to the extent directly caused by Monk On The Go's own proven negligence or wilful misconduct.

Patients and Attendants should review the applicable terms and conditions of the relevant Service Provider before purchasing or using such services.

FEES, PAYMENTS AND REFUNDS

Fees payable to Monk On The Go for facilitation or other Services will be communicated to the Patient before the relevant Service is provided, wherever reasonably practicable.

Hospital and other third-party charges may be separate from Monk On The Go's facilitation fees.

Unless expressly agreed otherwise in writing:

  • Hospital bills are payable directly to the relevant Hospital Partner;
  • Third-party service charges may be payable directly to the relevant Service Provider;
  • Monk On The Go's facilitation fees relate to the Services provided by Monk On The Go and are separate from medical treatment charges.

Any cancellation, refund or rescheduling shall be subject to the terms communicated for the particular Service, package or engagement.

Where a third-party provider has already incurred costs or imposed cancellation charges, such amounts may be non-refundable.

SPECIAL PROGRAMMES, GROUP BATCHES AND PACKAGES

From time to time, Monk On The Go may offer special healthcare programmes, treatment cohorts, group travel arrangements, surgical batches, packages or promotional programmes.

Such programmes may have:

  • Limited capacity;
  • Specific eligibility criteria;
  • Fixed dates;
  • Specific hospitals or doctors;
  • Payment deadlines;
  • Special cancellation terms;
  • Package-specific inclusions and exclusions; and
  • Other conditions communicated at the time of registration.

Registration for such a programme does not guarantee participation until the Patient has satisfied the applicable eligibility, documentation and payment requirements and received confirmation from Monk On The Go.

The terms specifically communicated for a particular programme shall apply in addition to these Terms.

PATIENT AND ATTENDANT RESPONSIBILITIES

Patients and Attendants agree to:

  • Provide accurate and complete information;
  • Provide authentic medical and travel documents;
  • Follow reasonable instructions provided by the treating healthcare team;
  • Comply with hospital rules and applicable laws;
  • Make payments within agreed timelines;
  • Maintain valid travel documentation;
  • Inform Monk On The Go promptly of material changes affecting the journey;
  • Treat Monk On The Go employees, doctors, hospital staff, interpreters and Service Providers respectfully; and
  • Not misuse the Site or Services.

Patients and Attendants remain responsible for their personal belongings, documents, money, medications and other personal property unless expressly accepted into the custody of Monk On The Go.

MINORS

A minor may not independently register for or engage Monk On The Go's Services.

Where Services are sought for a minor, the parent or legal guardian must provide the necessary information, permissions and consents on behalf of the minor.

The parent or legal guardian remains responsible for decisions and communications made on behalf of the minor.

This provision is consistent with Monk On The Go's Privacy Policy, which requires parental or legal guardian consent for the processing of a minor Patient's Personal and Health Information.

INFORMATION RELATING TO OTHER INDIVIDUALS

If you provide Monk On The Go with Personal Information or Health Information relating to another individual, including an Attendant, Companion, family member or another Patient, you represent that you have the necessary authority and consent to provide such information.

You agree not to knowingly provide information belonging to another person without appropriate authorization.

PRIVACY AND PERSONAL INFORMATION

Your use of the Site and Services is also governed by our Privacy Policy.

Monk On The Go may collect and process Personal Information and, where applicable, Health Information for purposes including medical coordination, hospital matching, second opinions, travel and accommodation arrangements, communication, payment administration and related Services.

Health Information is treated as sensitive information and is subject to enhanced safeguards as described in our Privacy Policy.

By using the Site or engaging our Services, you acknowledge that you have reviewed our Privacy Policy.

CONFIDENTIALITY OF MEDICAL INFORMATION

Monk On The Go will handle Health Information in accordance with its Privacy Policy and applicable law.

Where necessary to provide requested Services, Health Information may be shared with relevant doctors, hospitals, specialists and Service Providers involved in the Patient's care or journey.

Such disclosure will be limited to information reasonably necessary for the relevant purpose, subject to applicable consent and legal requirements.

Monk On The Go does not sell Health Information to third parties.

WEBSITE CONTENT

The content available on the Site may include information about medical conditions, treatments, hospitals, doctors, destinations, healthcare services, travel, costs and related subjects.

Such content is intended for general informational purposes and should not be interpreted as medical, legal, financial or professional advice.

Information on the Site may change without notice.

We endeavour to maintain accurate and useful information but do not warrant that all information will always be complete, current, accurate or error-free.

TESTIMONIALS, REVIEWS AND PATIENT STORIES

Where permitted by applicable law and with appropriate consent, Monk On The Go may publish patient testimonials, reviews, photographs, videos or treatment stories for informational or promotional purposes.

Any testimonial represents the experience of the individual concerned and should not be interpreted as a guarantee of a similar outcome for another Patient.

Medical outcomes vary between individuals.

INTELLECTUAL PROPERTY

Unless otherwise stated, the Site and its contents, including text, graphics, photographs, logos, trademarks, designs, videos, documents, layouts and other materials, are owned by or licensed to Monk On The Go.

You may access and use the Site for lawful personal and informational purposes.

You may not, without prior written permission:

  • Copy or reproduce substantial portions of the Site;
  • Republish Site content;
  • Commercially exploit Site content;
  • Modify or create derivative works from Site content;
  • Use Monk On The Go's trademarks or branding;
  • Scrape, systematically download or reproduce Site content; or
  • Represent that you are affiliated with Monk On The Go.

PROHIBITED USE

You agree not to use the Site or Services:

  • For any unlawful purpose;
  • To submit false, misleading or fraudulent information;
  • To impersonate another person;
  • To interfere with the operation or security of the Site;
  • To introduce malicious software or harmful code;
  • To attempt unauthorized access to systems or accounts;
  • To collect information about other users without authorization;
  • To misuse medical information;
  • To harass or threaten Monk On The Go personnel or Service Providers; or
  • In any manner that could harm Monk On The Go, its Patients, Hospital Partners or Service Providers.

We reserve the right to suspend or terminate access where we reasonably believe that these Terms have been violated.

THIRD-PARTY WEBSITES AND LINKS

The Site may contain links to websites or resources operated by third parties.

Such links are provided for convenience and informational purposes.

Monk On The Go does not necessarily endorse or control third-party websites and is not responsible for their content, privacy practices, security, availability or terms.

Your use of third-party websites is subject to the terms and policies of those websites.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Monk On The Go shall not be liable for indirect, incidental, special, consequential or unforeseeable loss arising from:

  • Medical treatment or medical decisions made by independent doctors or Hospital Partners;
  • Medical complications or treatment outcomes;
  • Acts or omissions of independent Service Providers;
  • Visa refusals or immigration decisions;
  • Airline cancellations or travel disruption;
  • Hotel or transportation issues;
  • Delays caused by third parties;
  • Events beyond our reasonable control;
  • Inaccurate information supplied by a Patient or Attendant; or
  • Unauthorized use of the Site by a user.

Nothing in these Terms shall exclude or limit liability that cannot lawfully be excluded or limited under applicable law.

EVENTS BEYOND OUR CONTROL

Monk On The Go shall not be responsible for failure or delay in providing Services where such failure or delay results from circumstances beyond our reasonable control.

Such circumstances may include natural disasters, epidemics or pandemics, war, civil unrest, government restrictions, changes in law, strikes, transportation disruption, airport closures, internet or telecommunications failures, cyber incidents, hospital emergencies or other circumstances beyond our reasonable control.

Where reasonably possible, Monk On The Go will endeavour to communicate material disruptions and assist Patients in identifying available alternatives.

INDEMNITY

To the extent permitted by applicable law, you agree to indemnify and hold harmless Monk On The Go, Monk Care International OPC Private Limited, its directors, employees, representatives and authorised personnel from claims, losses, liabilities, costs or expenses arising from:

  • Your breach of these Terms;
  • Your submission of false, inaccurate or unauthorized information;
  • Your unlawful use of the Site or Services;
  • Your violation of the rights of another person; or
  • Your misuse of the Services.

This provision shall not apply to the extent that a claim arises from the proven negligence, wilful misconduct or other liability of Monk On The Go that cannot lawfully be excluded.

SUSPENSION OR TERMINATION

Monk On The Go may suspend or terminate access to the Site or discontinue Services where reasonably necessary, including in circumstances involving:

  • Breach of these Terms;
  • Fraudulent or misleading information;
  • Non-payment;
  • Abuse or harassment;
  • Legal or regulatory requirements;
  • Safety concerns; or
  • Operational circumstances making continuation impracticable.

Termination shall not affect rights or obligations that accrued before termination.

CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in our Services, business practices, technology, legal requirements or regulatory requirements.

The updated Terms will be published on the Site with an updated effective date.

Your continued use of the Site or Services after the revised Terms become effective constitutes acceptance of the updated Terms, subject to applicable law.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of India.

Subject to the arbitration provision below, courts having appropriate jurisdiction in Mumbai, Maharashtra, India shall have jurisdiction over matters arising in connection with these Terms, to the extent permitted by applicable law.

DISPUTE RESOLUTION AND ARBITRATION

Any dispute, controversy or claim arising out of or relating to these Terms or the Services provided by Monk On The Go shall, where required or permitted by applicable law, be referred to arbitration by a sole arbitrator appointed in accordance with applicable Indian arbitration law.

The seat of arbitration shall be Mumbai, Maharashtra, India.

The proceedings shall be conducted in English.

The arbitration shall be conducted in accordance with the applicable arbitration laws of India.

Nothing in this clause shall prevent either party from seeking urgent interim or protective relief from a court of competent jurisdiction where such relief is legally available.

SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable, where legally permissible.

The remaining provisions shall continue in full force and effect.

NO WAIVER

Failure by Monk On The Go to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision or any other provision in the future.

ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any specific written terms, quotations, package conditions or service agreements applicable to a particular engagement,

constitute the agreement governing your use of the Site and Services, to the extent applicable.

Where specific written terms for a particular Service conflict with these general Terms, the specific written terms shall prevail to the extent of that conflict.
